Social media intermediaries

Online platforms or services that enable users to create, share, or exchange content and information. They are subject to provisions within the IT Act regarding user content and their liability.

IT Act

The Information Technology Act, 2000, is the primary legislation in India that deals with cybercrime and electronic commerce. It provides legal recognition to transactions carried out by means of electronic data interchange and other means of electronic communication, commonly referred to as electronic commerce, which in turn facilitates, but does not necessarily require, the use of the computer, computer system or computer network by the parties to any electronic transaction.

Section 79(3)(b) of IT Act

This provision of the Information Technology Act states that the legal immunity granted to online platforms (Section 79(1)) is lost if they fail to remove user-generated content when notified by government authorities to do so.
