Legal Framework w.r.t Surrogate Advertising in India

  • Consumer Protection Act (CPA), 2019: Under Section 10 of the CPA, the Central Consumer Protection Authority (CCPA) issues guidelines that explicitly prohibit surrogate or indirect advertising. 
  • Food Safety and Standards (FSS) Act, 2006
    • Section 24 restricts misleading or deceptive food advertisements.
    • Section 53 permits a fine of up to ₹10 lakh for anyone party to the publication of a misleading food advertisement.
  • Cigarettes and Other Tobacco Products Act (COTPA), 2003: Section 5 strictly prohibits those engaged in the production, supply, distribution, or advertising of tobacco products from promoting them directly or indirectly.
  • Cable Television Network Rules, 1994/1995: Rule 7 prohibits direct or indirect TV promotion of alcohol and tobacco products.

  • United Breweries Limited v. Mumbai Grahak Panchayat: Companies guilty of misleading surrogate marketing were ordered to publish corrective public safety advertisements at their own cost to neutralize the impact of their campaigns.
